Welcome to RapidCheck Diagnostics ("RapidCheck Diagnostics," "RCBA Training Institute," "we," "our," or "us"). By accessing our website, scheduling an appointment, purchasing products or services, enrolling in training programs, or using any of our services, you agree to these Terms and Conditions.
These Terms apply to all customers, patients, students, businesses, employers, contractors, website visitors, and third parties worldwide unless prohibited by applicable law.
1. SERVICES
RapidCheck Diagnostics provides healthcare support services, diagnostic testing, specimen collection, laboratory support, compliance consulting, DOT and Non-DOT testing, DNA testing coordination, fingerprinting, notary services, background screening, training programs, educational materials, wellness services, mobile services, business consulting, memberships, digital products, and other related services.
Availability of services may vary by jurisdiction.
2. NO MEDICAL ADVICE
Unless explicitly stated, RapidCheck Diagnostics does not provide medical diagnosis, treatment, or medical advice.
Any laboratory testing or screening performed should not replace evaluation by a licensed healthcare provider.
Customers should consult their physician regarding any medical concerns or test results.
3. ELIGIBILITY
You certify that:
• You are at least 18 years old or have legal guardian consent.
• Information you provide is accurate.
• You have authority to purchase services for yourself or your organization.
4. APPOINTMENTS
Appointments require accurate information.
Late arrivals may require rescheduling.
Missed appointments may result in forfeiture of fees.
Certain services require valid government-issued identification.
5. PAYMENTS
Payment is due at the time of booking unless otherwise agreed.
Prices may change without notice.
Returned payments are subject to additional fees.
Taxes will be collected where legally required.
6. REFUNDS
Training programs, digital downloads, online courses, memberships, manuals, templates, and digital products are non-refundable once access has been granted.
Service refunds are evaluated individually.
Unused appointments may be subject to rescheduling policies.
7. TRAINING PROGRAMS
Enrollment does not guarantee employment, licensure, certification, government approval, contracts, or income.
Students are responsible for meeting all licensing, certification, employment, and state-specific requirements.
Certificates of Completion verify course completion only unless otherwise specified.
Third-party certifications remain subject to the issuing organization's eligibility requirements.
8. INTELLECTUAL PROPERTY
All training materials, manuals, videos, presentations, SOPs, logos, trademarks, branding, downloads, worksheets, digital products, graphics, photographs, and educational content remain the exclusive property of RapidCheck Diagnostics.
No content may be copied, shared, reproduced, sold, distributed, recorded, or taught without written permission.
Violation may result in legal action.
9. CONFIDENTIALITY
Clients agree not to disclose proprietary business information, training materials, pricing structures, trade secrets, or confidential processes.
10. HIPAA
Where applicable, RapidCheck Diagnostics follows federal privacy laws regarding protected health information.
Patients acknowledge receipt of applicable privacy notices when required.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, RapidCheck Diagnostics shall not be liable for:
• Lab Results or Diagnostics Test
• Business interruption
• Indirect damages
• Consequential damages
• Emotional distress
• Delayed laboratory results
• Third-party laboratory errors
• Shipping delays
• Technology failures
Maximum liability shall not exceed the amount paid for the specific service giving rise to the claim.
12. THIRD-PARTY SERVICES
Certain services involve independent laboratories, certification agencies, employers, government agencies, payment processors, software providers, or vendors.
RapidCheck Diagnostics is not responsible for third-party actions, decisions, delays, or policies.
13. RESULTS
Testing results are provided according to applicable laws and laboratory procedures.
Certain tests require confirmation by a certified laboratory before being considered final.
Customers are responsible for discussing results with their healthcare provider when appropriate.
14. WEBSITE USE
Users agree not to:
• Attempt unauthorized access
• Upload malicious software
• Copy website content
• Misrepresent their identity
• Violate applicable laws
15. INDEMNIFICATION
Users agree to defend and hold harmless RapidCheck Diagnostics, its owners, employees, contractors, instructors, affiliates, and representatives against claims arising from misuse of services, violation of these Terms, or unlawful conduct.
16. FORCE MAJEURE
RapidCheck Diagnostics shall not be liable for delays or failure to perform due to circumstances beyond reasonable control, including natural disasters, public health emergencies, government actions, labor disputes, internet outages, supplier failures, or acts of God.
17. GOVERNING LAW
These Terms shall be governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles.
Any dispute shall be brought exclusively in the appropriate state or federal court located in North Carolina unless otherwise required by applicable law.
18. GLOBAL CUSTOMERS
Customers outside the United States are responsible for complying with their local laws, regulations, licensing requirements, import restrictions, and professional practice standards.
RapidCheck Diagnostics makes no representation that all services or training satisfy regulatory requirements outside the United States.
19. CHANGES
RapidCheck Diagnostics reserves the right to modify these Terms at any time. Continued use of our website or services constitutes acceptance of the updated Terms.
